88_R   HB 1719 Read Bill Raymond, Richard (D) Failed: Referred to State Affairs 2023.03.07 Public Notice Monitor 3 Relating to local option elections to legalize or prohibit the operation of eight-liners.

88_R   HB 3334 Read Bill Canales, Terry (D) Failed: Referred to State Affairs 2023.03.14 Open Records Monitor 3 Relating to the collection and disclosure of certain public information.

This bill would increase access to public information by eliminating some of the privileges that currently allow for withholding. The “basic information” piece would make clear that basic information about an incident (which the press has a right to) is not limited to just arrests and crimes, but would apply to incidents that don’t necessarily result in an arrest. The last section regarding “video” would ensure that audio recordings aren’t subject to the stricter standards for releasing body cams.

Companion is SB 1658 by Chuy Hinojosa

88_R   HB 3117 Read Bill Morales, Eddie (D) Failed: Referred to State Affairs 2023.03.14 Public Notice Monitor 3 Relating to the type of newspaper required for the publication of notices by governmental entities or representatives in certain counties.

Trying to get notices into the Eagle Pass newspaper. Amends Gov't Code 2051.0441, counties with no newspaper. Allows local government to name newspaper of record. Same bill was filed last session, but didn’t get a hearing.

3/15/23: Discussed HB 3117, a bill to fix the problem with Eagle Pass and Maverick County notices having to run in San Antonio Express-News, 140 miles away. The bill could present unintended consequences. We suggested they amend the bill to the language that Fannin County used to carve out an exception. Aaron will contact Leg. Council to see about amending. Yvonne will be our contact 512-463-2910.

3/21 Follow up with Yvonne, She is waiting on Leg. Council for committee substitute. Chief of Staff Aaron Gibson requested a carve out like Fannin County has.

Prohibits state agencies from purchasing periodicals. Bad public policy.

Similar to Springer's bill.

88_R   HB 2221 Read Bill Harrison, Brian (R) Failed: Referred to Ways & Means 2023.03.09 Public Notice Monitor 3 Relating to the vote required in an election to approve an ad valorem tax rate that exceeds a taxing unit's voter-approval tax rate.

Per Reid Pillifant: HB 2221 just changes the percentage required to approve a tax rate (from a majority to 60 percent). Suggests we monitor.

88_R   HB 2220 Read Bill Harrison, Brian (R) Failed: Referred to Ways & Means 2023.03.09 Public Notice Monitor 3 Relating to the calculation of certain ad valorem tax rates of a taxing unit and the manner in which a proposed ad valorem tax rate that exceeds the voter-approval tax rate is approved.

Per Reid Pillifant: HB 220 Tweaks the text of the notice that’s required, but doesn’t alter where notice appears. Worth monitoring

88_R   HB 2666 Read Bill Campos, Liz (D) Failed: Referred to Ways & Means 2023.03.13 Public Notice Monitor 3 Relating to the limitation on the total amount of ad valorem taxes that a school district may impose on the residence homestead of an individual and the surviving spouse.

88_R   HB 4717 Read Bill Cortez, Philip (D) Failed: Referred to Ways & Means 2023.03.22 Public Notice Monitor 3 Relating to a franchise tax credit for taxable entities that provide child care.

This bill preserves newspaper notice to establish such a tax. The bill requires an election to conform to Section 775.018, which cross-references Elections Code 4.003, and that section requires newspaper notice. This bill would require more disclosure in the notice, but wouldn’t change the newspaper requirement

88_R   hb 4852 Read Bill Harrison, Brian (R) Failed: Referred to Ways & Means 2023.03.23 Public Notice Monitor 3 Relating to the form of a notice of public hearing on a proposed ad valorem tax rate.

Monitor for possible malignant amendments. Reid: "This bill doesn’t appear to affect how notice is provided. The Tax Code already makes the notices newspaper-optional: (c)  The notice of a public hearing under this section may be delivered by mail to each property owner in the taxing unit, or may be published in a newspaper.  If the notice is published in a newspaper, it may not be in the part of the paper in which legal notices and classified advertisements appear.  If the taxing unit publishes the notice in a newspaper, the taxing unit must also post the notice prominently on the home page of the Internet website of the taxing unit from the date the notice is first published until the public hearing is concluded."
